PACKA-CHING TERMS AND CONDITIONS
Who We Are
We are Polyco and would like to offer you an opportunity to use the Packa-Ching recycling facility by delivering recyclable waste to one of the Entrepreneurs’ Packa-Ching trailers at our Packa-Ching collection sites in exchange for payment. If you do so, then our relationship with you will be as described in this document.
We also have arrangements with other people or companies who assist us in recycling and in managing the payment system that you will use for the recycling facility. We call these people our “Partners”.
Use Subject to these Terms and Conditions
Your relationship and any and all interactions with Packa-Ching, including all interactions with the collection and weighing equipment, our Entrepreneurs’ Packa-Ching trailers, the collection site and your use of the funds received from Packa-Ching (irrespective of the source), are subject to our standard terms and conditions, which are also available at www.packaching.co.za/legal-notices.
By interacting with the equipment, our Entrepreneurs’ Packa-Ching trailers, the Entrepreneur and his/her employees, being at the collections site or receiving any funds from Packa-Ching, you agree to adhere to the provisions of these terms and conditions.
If you do not agree to these terms and conditions, you must cease your interaction with the equipment, our Entrepreneurs’ Packa-Ching trailers and the collection sites immediately.
Please note that, due to legal and other developments, Packa-Ching may be required to amend these terms and conditions from time to time without notice. It is your duty to remain familiar with the current version of these terms and conditions.
Continued interaction with the equipment, the Entrepreneur and the collection sites after amendments to these terms and conditions constitutes your acceptance of the terms and conditions as amended.
Agreement
If you bring recyclable packaging waste to one of the Entrepreneurs’ Packa-Ching trailers, your material will be weighed and if found acceptable, you will be paid a cash amount through Touchstone Enterprise Services (Pty) Ltd (our “Payment System Service Provider”) in exchange.
You won’t be forced to actually bring us any recyclable materials or waste. However, we will only pay you for materials when you actually bring them to our Entrepreneurs’ Packa-Ching trailers.
The amount that we pay you for the materials that you bring to our Entrepreneurs’ Packa-Ching trailers will depend on the weight and current price for those specific materials. This price can change at any time subject to market changes.
You are not obliged to sell your materials to us if you are not happy with the prices we are willing to pay.
Collection of Recyclable Materials
The recyclable materials we collect include plastic, paper, metal cans and glass.
If we think that any materials you bring to our Entrepreneurs’ Packa-Ching trailers or collection sites are not suitable for recycling (and we have the final say on this), then we can refuse to accept them. If we reject materials, then you will have no claim against us or our Partners or our Entrepreneurs for payment for those materials.
We can also change the types of materials that we accept for recycling at any time. We may be required to do this by our Partners. If we do this, we will notify you when you visit our Entrepreneurs’ Packa-Ching trailers .
Payment System
We will pay you a monetary value through Touchstone Enterprise Services (Pty) Ltd (our “Payment System Service Provider”) in exchange for material we collect from you.
In order to register you with our Payment Service Provider, you will need to accept these terms and conditions.
Payments are made to your cellphone number and any transactions through the payment system are done at your own risk.
Neither we nor our Partners or our Entrepreneurs are responsible for any loss arising from any payment to a wrong number.
Neither we nor our Partners or our Entrepreneurs are responsible for any loss arising from any failure or malfunction of electronic facilities or delay in the Payment System Service Provider’s devices or supporting or shared networks, which are beyond our reasonable control.
Limitation of Liability
We, our Entrepreneurs and our Partners take reasonable care when we collect the materials and make payments to you, but we give you no guarantees of any kind that we will meet any standard. In addition, we, our Entrepreneurs and our Partners will not accept liability of any kind if you suffer any loss while dealing with us, our Entrepreneurs or with our Partners, whether the loss was through the use of Entrepreneurs’ Packa-Ching trailers or in any other circumstances.
By accepting these terms and conditions, you agree to indemnify, defend, and hold us, our Entrepreneurs and our Partners harmless from any and all damages claimed by any third party against us arising from these terms and conditions or your relationship with us.
Personal Information
You agree that we may collect your cellphone number, gender and date of birth from you, which is the information that we need to process recyclable materials and to pay you.
You agree that we may use this information for these purposes. We will not use this information for any other purpose.
You agree that we may share your information with our Entrepreneurs and Partners if they need it for payments to you. Your information will not be shared with anyone else without your permission.
As permitted by the Protection of Personal Information Act 4 of 2013, we mayyou’re your personal information collected to compile profiles for statistical and research purposes.
General and Interpretation
These terms and conditions are the whole of the agreement between you and us and we will not be bound by any other terms, conditions or representations.
You agree that you have not been forced or induced to enter into this agreement by anything that we, our Entrepreneurs or our Partners have said or done.
If a clause of this agreement can be read in a way that would make it unlawful, invalid or unenforceable, or in another way that will make it lawful, valid and enforceable, then the clause must be interpreted in such a way as to make it lawful, valid and enforceable.
If part of this agreement is found to be unlawful, invalid or unenforceable, then the agreement must be read as if that part has been removed, and the rest of the agreement will be enforceable, but only if removing that part will not change the nature of this agreement.
